Scope

These terms govern the use of the website desousa.estate and, unless a separate written agreement says otherwise, the estate agency services provided by Micaela Franco de Sousa, Unipessoal Lda, AMI licence 18584. By using this website you accept these terms.

Our services

We act as an estate agency for buyers and sellers on Madeira and Porto Santo: sourcing and off-market search, due diligence support, transaction coordination, construction and project supervision, and property management. The precise scope, duration and fee of any engagement are agreed individually in writing.

Property information

Property details, prices, areas, plans and availability are based on information from owners, developers and public registers. They are provided in good faith but without warranty, may change at any time and are non-binding until confirmed in writing. Nothing on this website constitutes an offer capable of acceptance.

No legal or tax advice

Information on this website about taxes, fees, permits or the purchase process is general guidance, not legal, tax or financial advice. We work alongside independent lawyers, notaries and accountants and recommend that you appoint your own advisers for any transaction.

Commission and fees

For sellers, the agency commission and its payment terms are set out in the mediation agreement signed before marketing begins. For buyers, any fee for search or support services is agreed in writing in advance. Commission becomes payable as stipulated in that agreement, normally on completion of the deed.

Right of withdrawal for consumers

If you are a consumer and conclude a contract with us at a distance or away from our business premises, you may withdraw within 14 days without giving reasons, by an unambiguous statement sent to micaela@desousa.estate. If you ask us to begin performance during that period, you owe a proportionate amount for services already provided.

Use of the website

You may use this website for personal, non-commercial purposes. Automated retrieval, scraping, republishing of listings or images, and any use that impairs the operation or security of the site are not permitted.

Intellectual property

All texts, photographs, plans, graphics and the layout of this website are protected by copyright and belong to us or our licensors. Reproduction, distribution or public display requires our prior written consent. Some images are generated or edited with artificial intelligence and are labelled accordingly.

Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only for breach of an essential contractual obligation and limited to the foreseeable damage typical of the contract. We accept no liability for the availability of the website or for the content of external sites.

Governing law and jurisdiction

These terms are governed by Portuguese law. Mandatory consumer protection provisions of your country of residence remain unaffected. The place of jurisdiction for merchants is Funchal, Madeira. Consumers may also use the EU online dispute resolution platform at ec.europa.eu/consumers/odr.

Severability

If any provision of these terms is or becomes invalid, the validity of the remaining provisions is unaffected. The invalid provision is replaced by the lawful provision that comes closest to its economic purpose.
